The terms "we," "us," and "our" refer to Timber & Twine LLC, doing business as Timber & Twine. Timber & Twine operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Timber & Twine is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing information, payment information, and shipping information.

You represent and warrant that all information you provide through our store is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity occurring through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We have made every reasonable effort to provide an accurate representation of our products and services in our online store. However, colors, materials, wood grain, engraving appearance, product appearance, and other visual characteristics may vary from how they appear on your screen due to your device, display settings, lighting, photography, manufacturing variations, and the natural or simulated characteristics of materials used in our products.

Product images, mockups, digital renderings, personalization previews, and lifestyle images are intended to reasonably represent the product but may not depict every variation in the finished item.

Because many Timber & Twine products may be personalized, engraved, etched, printed, or otherwise customized, minor variations in positioning, color, grain, engraving appearance, and other characteristics may occur as part of the production process.

We do not warrant that the appearance or quality of products or services purchased by you will exactly match their appearance on your particular screen or device.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 – ORDERS, PERSONALIZATION AND CUSTOM PRODUCTS

When you place an order, you are making an offer to purchase. Timber & Twine reserves the right to accept or decline an order for any lawful reason at our discretion. Your order is not accepted until Timber & Twine confirms acceptance. We must receive and process your payment before your order is accepted.

Please carefully review all information in your order before submitting it, particularly names, dates, initials, monograms, messages, designs, spelling, capitalization, punctuation, and other personalization information.

You are responsible for ensuring that all personalization information submitted with your order is accurate.

Because personalized and custom products may enter production shortly after an order is accepted, we may be unable to accommodate cancellations, modifications, or corrections after an order has been placed or production has begun.

If we do not accept an order, make a material change to an order, or cancel an order, we will attempt to notify you using the email address, billing information, and/or telephone number provided when the order was placed.

Personalized and Custom Items

Products that are personalized, engraved, etched, monogrammed, custom-designed, or otherwise made specifically according to information or selections supplied by the customer are made specifically for that customer.

If a personalized or custom item is produced as ordered and is materially consistent with the applicable product listing and the personalization information submitted by the customer, the item is final sale and is not eligible for a return, exchange, or refund, except where otherwise required by applicable law.

This policy exists because personalized and custom-made products generally cannot be resold to another customer.

This restriction does not eliminate any rights or remedies you may have under applicable law and does not prevent you from contacting us if your order arrives damaged, defective, materially different from the applicable product description, or with personalization that differs from the personalization information you submitted.

Eligibility for returns, refunds, replacements, or exchanges is otherwise governed by our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export unless otherwise agreed by Timber & Twine.

Customer-Provided Designs and Content

If you provide us with a logo, photograph, graphic, artwork, wording, trademark, design, or other material for use in a personalized or custom product ("Customer Content"), you represent and warrant that you own the Customer Content or have all permissions, licenses, and other rights necessary for us to reproduce and use it to fulfill your order.

By submitting Customer Content, you grant Timber & Twine a non-exclusive license to reproduce, modify as reasonably necessary for production, and use the Customer Content for the limited purpose of processing and fulfilling your order.

We reserve the right to decline Customer Content or personalization requests that we reasonably believe may violate applicable law or the rights of another person.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect when the order is placed and will be set out in your order confirmation.

Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, customs, duties, or import charges.

Prices posted in our online store may differ from prices offered through other sales channels or third-party marketplaces.

We may periodically offer promotions that affect pricing and that are governed by separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the applicable promotion terms will govern with respect to that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store and to promptly update such information as necessary.

You represent and warrant that: (i) payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method provided; (iii) charges incurred by you will be honored by your payment provider; and (iv) you will pay all charges incurred at the applicable prices, including shipping, handling, and applicable taxes.

SECTION 5 – SHIPPING AND DELIVERY

All delivery and processing times are estimates only and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs processing, weather, natural disasters, incorrect or incomplete addresses supplied by customers, or other events outside our reasonable control.

Once products are transferred to the applicable carrier, risk of loss and responsibility for delivery will be determined in accordance with applicable law.

Customers are responsible for providing an accurate and complete shipping address when placing an order. Additional shipping charges resulting from an incorrect or incomplete address may be the customer's responsibility to the extent permitted by applicable law.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by Timber & Twine, its affiliates, or licensors and are protected by applicable U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit material from the Services without our prior written consent except as otherwise permitted by applicable law.

Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property belonging to Timber & Twine, Shopify, or any third party.

All rights not expressly granted herein are reserved.

Timber & Twine's names, logos, product and service names, designs, and slogans are trademarks of Timber & Twine or its affiliates or licensors. You must not use such trademarks without prior written permission from Timber & Twine.

Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing through the Services are trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS

You may be provided access to tools offered by third parties as part of the Services, which we neither monitor nor control.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without warranties, representations, or conditions of any kind and without endorsement. To the fullest extent permitted by applicable law, we shall have no liability arising from or relating to your use of optional third-party tools.

Your use of optional tools offered through the Services is at your own risk and discretion, and you should familiarize yourself with and approve the terms under which those tools are provided.

We may also offer new features, tools, and resources through the Services in the future. Such features will be considered part of the Services and subject to these Terms.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality.

We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites you choose to access.

If you leave the Services to access third-party materials or websites, you do so at your own risk.

To the fullest extent permitted by law, we are not liable for harm or damages related to your access to third-party websites or your purchase or use of products, services, resources, or content provided by third parties.

Please carefully review third parties' policies and practices before engaging in a transaction with them. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the applicable third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Timber & Twine is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our Store are made directly with Timber & Twine.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Timber & Twine, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Timber & Twine, to the extent permitted by applicable law.

SECTION 10 – PRIVACY POLICY

Personal information we collect through the Services is subject to our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide and improve the Services.

Information you submit through the Services may be transmitted to and shared with Shopify and other service providers, which may be located in countries other than your country of residence, as further described in the applicable privacy policies.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation or incentives received in connection with submitting Feedback; and (iii) your Feedback complies with these Terms.

We are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

We may, but have no obligation to, monitor, edit, or remove Feedback that we determine violates applicable law, the rights of another person, or these Terms.

You agree that your Feedback will not violate the rights of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights.

You are solely responsible for Feedback you submit and its accuracy.

Occasionally, information provided through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, personalization options, pricing, promotions, offers, shipping charges, transit times, or availability.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if information is inaccurate, including after an order has been submitted, subject to applicable law.

SECTION 13 – PROHIBITED USES

You may access and use the Services for lawful purposes only.

You may not access or use the Services, directly or indirectly, to:

(a) engage in unlawful or malicious activity;

(b) violate international, federal, state, provincial, territorial, or local laws, rules, regulations, or ordinances;

(c) infringe or violate our intellectual property rights or those of another person;

(f) transmit viruses, malware, or other malicious code;

Agents must not conceal or obfuscate automated access, circumvent CAPTCHAs or other measures designed to distinguish computer use from human use, or circumvent measures intended to block, limit, modify, or control automated access to the Services.

We may terminate this agreement or your access to the Services, or any part thereof, in our discretion where permitted by applicable law, including for violations of these Terms. You will remain responsible for amounts properly due up to and including the effective date of termination.

Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, severability, assignment, governing law, and other provisions intended to survive termination.

EXCEPT AS EXPRESSLY STATED BY TIMBER & TWINE AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions limit or do not allow certain warranty disclaimers, so some or all of the foregoing may not apply to you.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL TIMBER & TWINE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED THROUGH THE SERVICES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Some jurisdictions do not permit certain limitations or exclusions of liability, in which case such limitations or exclusions will apply only to the fullest extent permitted by applicable law.

SECTION 18 – INDEMNIFICATION

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless Timber & Twine, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising from:

(1) your breach of these Terms or documents incorporated by reference;

(2) your violation of applicable law or the rights of a third party; or

(3) your access to and use of the Services.

We will notify you of an indemnifiable claim, provided that failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and any unenforceable portion shall be deemed severed from these Terms.

These Terms and any policies or operating rules posted by us through the Services constitute the entire agreement and understanding between you and us concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning the same subject matter.

Any ambiguities in the interpretation of these Terms shall not automatically be construed against the drafting party.

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent, and any unauthorized attempt to do so will be void to the extent permitted by applicable law.

We may transfer, assign, or delegate these Terms and our rights and obligations as permitted by applicable law.

These Terms of Service and any separate agreements whereby Timber & Twine provides Services to you shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.

To the extent permitted by applicable law, you and Timber & Twine consent to the personal jurisdiction and venue of the applicable state and federal courts located in or serving Collin County, Texas.

Nothing in this section is intended to deprive a consumer of any mandatory protections or rights available under applicable law.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.
